Privacy Policy

TDG Creative, LLC ("TDG Creative," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect when you visit www.tdgcreative.com and related pages, including our promotional products store at promo.tdgcreative.com (together, the "Site"), how we use that information, and the choices you have.

By using the Site, you agree to the practices described in this Policy. If you do not agree, please do not use the Site.

1. Who this Policy applies to

The Site is intended for users located in the United States. Our services are directed to adults who are placing orders on behalf of themselves or an organization (such as a school, booster club, PTA/PTO, business, or corporation). See Section 10 for information about children's privacy.

2. Information we collect

Information you provide to us. We collect information you choose to give us, including when you:

  • Request a quote or contact us (name, email address, phone number, organization name, and details about your project);
  • Subscribe to our newsletter (email address);
  • Submit a custom art request or upload artwork, logos, or design files;
  • Use our online design tools to create a design;
  • Place an order or set up a fundraising or spirit-wear store (name, email, phone, shipping and billing details, organization information, and order details).

Payment information. When you make a purchase, payment card and billing details are collected and processed by our third-party payment processor and/or store platform. We do not store full payment card numbers on our own systems.

Information collected automatically. When you use the Site, we and our service providers may automatically collect certain information, such as your IP address, device and browser type, operating system, referring pages, pages viewed, links clicked, and dates and times of access. Some of this information is collected through cookies and similar technologies (see Section 5).

Information from third parties. We may receive information from service providers that help us operate the Site, from our store or fulfillment platform, and from social media platforms when you interact with our pages or ads.

3. How we use your information

We use the information we collect to:

  • Provide quotes, respond to inquiries, and communicate with you;
  • Process, produce, and fulfill orders, including custom apparel, branded merchandise, and fundraising and spirit-wear store orders;
  • Operate, maintain, and improve the Site and our design tools;
  • Send you newsletters, promotions, and updates (where permitted, and subject to your ability to opt out);
  • Prevent fraud, enforce our Terms of Service, and protect the security of the Site;
  • Comply with legal obligations and resolve disputes.

4. Legal bases and how we handle your information

We process personal information as needed to provide our services and communicate with you, with your consent (for example, for certain cookies and marketing emails), to pursue our legitimate business interests, and to comply with legal obligations.

5. Cookies and similar technologies

We use cookies and similar technologies to operate the Site, remember your preferences, understand how the Site is used, and (where applicable) support marketing. Cookies fall into general categories:

  • Strictly necessary cookies, required for the Site to function;
  • Analytics cookies, which help us understand Site usage;
  • Marketing cookies, which may be used to measure and support advertising.

You can manage your preferences at any time through the "Cookie settings" link in our website footer. Depending on your location, non-essential cookies are only used after you provide consent. You can also control cookies through your browser settings. Disabling some cookies may affect how the Site functions.

6. How we share information

We do not sell your personal information for money. We may share information in the following circumstances:

  • Service providers who perform services for us, such as website hosting, analytics, email delivery, payment processing, order production, printing, and shipping/fulfillment;
  • Our store and fulfillment platform used to operate the promotional products store and online fundraising/spirit-wear stores;
  • Advertising and social media partners, where you have consented to marketing cookies. Depending on how these tools are configured, this activity may be considered "sharing" or "targeted advertising" under certain U.S. state privacy laws; you can opt out as described in Section 7;
  • Legal and safety purposes, such as to comply with law, respond to lawful requests, or protect the rights, property, or safety of TDG Creative, our customers, or others;
  • Business transfers, in connection with a merger, acquisition, financing, or sale of assets.

7. Your privacy rights

Depending on your state of residence, you may have rights to:

  • Access or obtain a copy of the personal information we hold about you;
  • Correct inaccurate personal information;
  • Request deletion of your personal information;
  • Opt out of targeted advertising, the "sale" or "sharing" of personal information, and certain profiling.

How to exercise your rights. You may submit a request by contacting us using the details in Section 15. We will verify your request and respond as required by applicable law. You may also designate an authorized agent to act on your behalf. We will not discriminate against you for exercising your rights.

California residents. If you are a California resident, you have the rights described above under the California Consumer Privacy Act (as amended). We do not sell personal information for money. Where we use advertising cookies, that activity may constitute "sharing" for cross-context behavioral advertising; you can opt out through our "Cookie settings" link or by contacting us. California residents may also have the right to limit the use of sensitive personal information, though we do not use personal information for those purposes.

8. Data retention

We keep personal information for as long as needed to provide our services, fulfill orders, maintain business records, and comply with our legal obligations, after which we delete or de-identify it.

9. Data security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

10. Children's privacy

The Site and our services are intended for adults. Although some of our products are used by children (for example, school spirit wear), orders are placed by adults such as parents, school staff, and organization representatives. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

11. Third-party links and services

The Site may link to third-party websites and services, including our store platform, payment processors, and social media pages. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies.

12. Marketing communications

If you subscribe to our newsletter or otherwise consent to marketing, we may send you emails about new designs, offers, and updates. You can opt out at any time by using the unsubscribe link in any marketing email or by contacting us. We may still send you non-promotional messages related to your orders or account.

13. Do Not Track and opt-out preference signals

Some browsers offer "Do Not Track" signals. Where required by law, we honor recognized opt-out preference signals (such as Global Privacy Control) as a valid request to opt out of the sale/sharing of personal information for the browser sending the signal.

14. Changes to this Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect means you accept the updated Policy.
